OVERVIEW
Welcome to Try a Bit (“Try a Bit”, “we”, “us”, “our”). We operate this online store and website (the “Services”) to provide you with a curated shopping experience. Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms & Conditions (the “Terms” or “Terms of Service”), together with any policies referenced or linked herein, describe your rights and responsibilities when you access or use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and by our Privacy Policy and any other policies referenced here (e.g., Refund Policy, Shipping Policy). If you do not agree, do not use the Services.
1. ACCESS & ACCOUNT

Age of majority. By using the Services, you confirm you are at least the age of majority in your place of residence and you consent to allow any of your minor dependents to use the Services on devices you own or manage.

Account information. To browse and purchase, you may be asked to provide information (e.g., email, billing, payment, and shipping details). You warrant that this information is accurate, current, and complete and that you have the rights necessary to provide it.

Security & responsibility. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You may not sell, transfer, or license your account to others.
2. OUR PRODUCTS
We aim to describe and display products accurately; however, colours and appearance can vary by device and settings. We do not warrant that the appearance or quality of any products or services will meet your expectations or exactly match on-screen images. Product descriptions, availability, and pricing may change at any time without notice. We may limit quantities or discontinue products at our discretion.
3. ORDERS

Offer & acceptance. When you place an order, you make an offer to purchase. We may accept or decline your order at our discretion. Your order is accepted once payment is processed and we issue an order confirmation.

Changes & cancellations. Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after acceptance. If we do not accept, change, or cancel an order, we will attempt to notify you using the contact details provided at checkout.

Non-resale. You confirm purchases are for personal or household use and not for resale or export unless we agree otherwise in writing.

Returns. Returns/exchanges are governed solely by our Refund Policy. See Section 9 for the Back-Ordered Horse Bits policy, which is a specific exception.
4. PRICES, TAXES & BILLING

Prices & promotions. Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of order and appears in your confirmation email. Unless stated, prices exclude taxes, shipping, handling, customs, and import duties.

Different channels. Prices on our website may differ from other channels or third-party stores.

Payment information. You agree to provide current, complete, and accurate payment details and to promptly update them as needed (e.g., card number and expiry). You warrant that (i) the payment information is true and complete; (ii) you are authorised to use it; (iii) charges will be honoured by your issuer; and (iv) you will pay all amounts due, including taxes and shipping.
5. PAYMENT METHODS; CHARGEBACKS; BNPL

Methods. We may accept major cards, Shop Pay, Apple Pay, Google Pay, bank transfers, gift cards, and—where available—Buy Now Pay Later (BNPL) options (e.g., Afterpay/Clearpay). Availability varies by region and is subject to provider terms.

Authorisation. By submitting a payment method, you authorise us (and Shopify Payments or other processors) to charge the total order amount, including taxes, shipping, and any additional fees disclosed at checkout.

Chargebacks & disputes. If you dispute a charge with your card issuer or BNPL provider, you agree to first contact us at info@tryabit.co.nz so we can attempt to resolve the issue. Unfounded or abusive chargebacks may result in account suspension and/or recovery of associated fees to the extent permitted by law.
6. SHIPPING & DELIVERY; RISK OF LOSS
Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you upon our delivery of products to the carrier. Please see our Shipping Policy for details.
7. INTELLECTUAL PROPERTY
The Services and all content (including trademarks, brands, text, images, graphics, video, and audio, and their selection/arrangement) are owned by Try a Bit or its licensors and protected by applicable intellectual property laws. You may use the Services for personal, non-commercial use only. Except as permitted by law, you may not reproduce, distribute, modify, create derivative works, publicly display, perform, republish, download, store, or transmit content without our prior written consent. All rights not expressly granted are reserved. Our names, logos, product/service names, designs, and slogans are our trademarks. Shopify’s marks are owned by Shopify. Other marks belong to their owners.
8. OPTIONAL TOOLS
We may provide access to tools or integrations offered by third parties. These are provided “as is” and “as available” without warranties or endorsements. Your use is at your own risk and subject to the relevant third party’s terms.
9. BACK-ORDERED HORSE BITS – NON-REFUNDABLE (CUSTOM POLICY)
Back-Ordered Horse Bits are non-refundable once your order is confirmed and payment is processed. Delivery timeframes are generally 6–8 weeks. A refund for a Back-Ordered Horse Bit will only be considered if the product has not arrived after the 6–8 week period has elapsed. If you have not received your bit within this timeframe, please contact our support team at info@tryabit.co.nz to initiate the review process. This policy enables us to offer a wide range of specialised bit options while maintaining transparent practices. If you do not agree with this policy or the timeframe, please contact us before placing your order.
10. RETURNS & EXCHANGES
Returns and exchanges are handled as described in our Refund Policy. Where applicable under New Zealand law, your statutory rights under the Consumer Guarantees Act 1993 (CGA) and the Fair Trading Act 1986 (FTA) may apply. Nothing in these Terms is intended to exclude rights that cannot lawfully be excluded.
11. THIRD-PARTY LINKS
Our Services may include materials or links to third-party websites. We are not responsible for evaluating or monitoring third-party content and are not liable for any third-party products, services, websites, or content. Review third-party policies before engaging in transactions with them.
12. RELATIONSHIP WITH SHOPIFY
Try a Bit is powered by Shopify, which enables our store. However, all sales are made directly with Try a Bit. Shopify is not responsible for any aspect of sales between you and Try a Bit, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Try a Bit.
13. PRIVACY
Personal information we collect is subject to our Privacy Policy. Because our Services are hosted by Shopify, certain information about your use of the Services is collected and processed by Shopify in order to operate and improve the platform. Information you submit may be transmitted to and processed by Shopify and service providers in other countries. Review our Privacy Policy for details and consult Shopify’s Privacy Policy as applicable.
14. USER CONTENT & FEEDBACK
If you submit reviews, ideas, suggestions, proposals, plans, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display such Feedback in any medium and for any purpose, including commercial purposes. You represent and warrant that you own or have the rights to submit the Feedback, have disclosed any incentives, and that your Feedback complies with these Terms and applicable law. We may monitor, edit, or remove content in our discretion. You are solely responsible for your Feedback and its accuracy.
15. ERRORS, INACCURACIES & OMISSIONS
From time to time there may be information on the Services that contains errors or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct, update, or cancel orders affected by such inaccuracies without prior notice (including after submission) where permitted by law.
16. PROHIBITED USES
You may use the Services only for lawful purposes. You agree not to, directly or indirectly: (a) use the Services for unlawful or malicious purposes; (b) violate any applicable laws or regulations; (c) infringe intellectual property rights; (d) harass, defame, intimidate, or harm others; (e) transmit false or misleading information; (f) upload or distribute malware or harmful code; (g) send unsolicited promotions or spam; (h) impersonate another person or entity; (i) collect or track others’ personal information without consent; (j) circumvent security features; or (k) engage in conduct that restricts or inhibits others’ use or that exposes Try a Bit, Shopify, or users to liability. We may suspend or terminate access for violations.
17. TERMINATION
We may terminate or suspend the Services (in whole or part) at any time, with or without notice, and you remain liable for all amounts due up to and including the date of termination. Sections intended to survive (including Intellectual Property, Feedback, Termination, Warranties, Liability, Indemnification, Severability, Entire Agreement, Assignment, Governing Law, and Privacy) will survive termination.
18. DISCLAIMERS OF WARRANTIES
Except as expressly stated by Try a Bit, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable. Some jurisdictions do not allow certain disclaimers; to that extent, this section may not apply to you.
19. LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no event shall Try a Bit or our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors (or Shopify and its affiliates) be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, revenue, savings, or data), whether in contract, tort (including negligence), strict liability, or otherwise, arising from or related to your use of the Services or any products, even if advised of the possibility of such damages. Where liability cannot be excluded under applicable law, our aggregate liability shall be limited to the amount you paid for the product(s) giving rise to the claim.
20. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Try a Bit, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities, claims, and reasonable legal fees arising out of: (1) your breach of these Terms or referenced policies; (2) your violation of law or third-party rights; or (3) your use of the Services. We will notify you of any indemnifiable claim (failure to promptly notify will not relieve your obligations unless materially prejudicial). We may control the defence and settlement at your expense; we will not agree to non-monetary obligations for you without your reasonable consent. You will cooperate with the defence.
21. NEW ZEALAND CONSUMER LAW
Nothing in these Terms seeks to exclude, restrict, or modify any consumer guarantees, rights, or remedies under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that cannot be excluded by law. If you are acquiring goods or services for business purposes (as defined in the CGA), you agree that the CGA does not apply to such supplies to the maximum extent permitted by law.
22. SEVERABILITY
If any provision of these Terms is unlawful, void, or unenforceable, that provision is enforceable to the maximum extent permitted, and the remainder remains in full force and effect.
23. WAIVER & ENTIRE AGREEMENT
A failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with policies posted on the Services, constitute the entire agreement between you and us regarding the Services and supersede prior agreements and communications.
24. ASSIGNMENT
You may not assign, transfer, or delegate these Terms or your rights or obligations without our prior written consent; any attempted assignment is void. We may assign or transfer these Terms without notice or consent.
25. GOVERNING LAW & JURISDICTION
These Terms and any separate agreements whereby we provide you Services are governed by the laws of New Zealand. You and Try a Bit submit to the exclusive jurisdiction of the courts of New Zealand (and any applicable New Zealand tribunals) for any dispute arising out of or relating to the Services.

Headings are for convenience only and do not affect interpretation.
27. CHANGES TO TERMS
You can review the most current version of these Terms on this page. We may update these Terms by posting changes on the website. We will notify you of any material changes as required by law, and such changes take effect on the specified date. Your continued use of the Services after changes are posted constitutes acceptance.
